ARBITRATION CLAUSE CAN BE INVOKED BY ASSIGNEE OF RIGHTS UNDER SAID CONTRACT: BOMBAY HIGH COURT The Bombay High Court has stated that an arbitration agreement is assignable, just as any other contract, and where the obligations and rights under an Agreement, containing an arbitration. This was done so because all rights in favour of the original party, the bench decided that there was no need to sign a separate arbitration agreement. The other party specifically acknowledged that a party to the arbitration agreement had been assigned in favour of the claimant. The court further held that since the obligation and rights under the Rental Agreement as assigned in favour of one party, there was no reason why the arbitration agreement should stand excluded, being part of the said Agreement.
