"HIGH COURT OF HIMACHAL PRADESH DISMISSES HUSBAND'S PLEA FOR DIVORCE ON ALLEGATIONS OF DESERTION AND CRUELTY, UPHOLDS WIFE'S RIGHT TO LIVE SEPARATELY" In a recent case, the Himachal Pradesh High Court has observed that no wife can be forced to live in the matrimonial home when the husband is keeping another lady with him. The Court dismissed a husband's plea for divorce on allegations of desertion and cruelty, stating that the wife had justifiable grounds to live separately. The Court found that the husband's allegations of cruelty were vague and general in nature and that the only thing that could be said to be proved on record was the fact that the wife had been residing separately from her husband since 1995. The Court upheld the family court's order dismissing the husband's plea for a divorce.
