Statements recorded under section 67 of the NDPS Act cannot be a ground of conviction: Jammu and Kashmir High Court. The High Court of Jammu and Kashmir, while dismissing the application seeking leave to appeal in the case of Union of India, Narcotics Control Bureau v. Rafi Ahmed, held that a non-accused cannot be convicted on the statement of co-accused recorded under Section 67 of the NDPS Act. It further stated that the statement couldn’t be used as a confessional statement being barred under the provision of Section 25 of the Evidence Act, 1872.
