If Defendant appeared in the case but after that he was absent hence passed the ex parte order: In the case of G. Ratna Raj vs. Sri Muthukumarasamy Permanent Fund Ltd. & Anr. (Civil Appeal No. 25822583 of 2011) court observed and discussed about Order 9 Rule 6(1)(a), Order 17 Rule 2& 3 of Code of Civil Procedure, 1908. Court observed that the defendant appeared in this case and at the time of cross examination of the Plaintiff he was absent. Hence trail court passed the ex parte order against the Defendants. After that Supreme Court set a side ex parte order on the basis of Order 9 Rule 13 on making of sufficient grounds by the Defendants for set a side ex parte.
