IF CONTRACTION IN DECISION HIGH COURT WILL PREVAIL OVER NGT State of Andhra Pradesh vs Raghu Rama Krishna Raju Kanumuru (MP) In this case, the State was running a resort at Rushikonda Hill, near Visakhapatnam. It was demolished for re¬constructing the resort at the same place. A writ petition challenging the said construction, was filed before the High Court of Andhra Pradesh. An interim order was passed by the High Court for the construction. But NGT prohibited the same action. To the Apex court the state made the contention that when High court has the jurisdiction then NGT cannot interfere. The court held that if contradict in decision High will prevail NGT.
