Declaration of void marriage.
The Supreme Court in the case of Deoki Panjhiyara v. Shashi Bhushan Narayan Azad held that seeking a formal declaration stating that the second marriage during the subsistence of an earlier marriage is void, is optional. However when there is a dispute regarding the factum of earlier marriage of one of the spouses, declaration of nullity of second marriage must be obtained from a competent court.
