"Royalty has to be paid to the authors by the radio stations for broadcasting songs". In that case of Indian Performing right society Ltd. V. Rajasthan Patrika Pvt. Ltd. the Bombay High Court passed an order refraining Radio Tadka and Radio city from broadcasting the songs of India performing Rights society because the royalty was not been paid to the authors of the songs. The Royalty has to be equally paid to the author as being paid to the producer of the work. The court held that a 2012 amendment to the Copyright Act has fundamentally changed the rights of authors of original works. The amendment allows original authors, who were earlier not entitled to royalties once their work became part of a film, to claim royalties for any use of their work, except screening in a cinema hall in a movie. The court also held that the authors cannot waive their right to receive royalties for the use of their original works. The defendants in the case are the operators of FM radio channels Radio Mirchi and Radio City FM.
