WITNESS TESTIMONY INCONSISTENT WITH MEDICAL EVIDENCE ALTERS CONVICTION FOR MURDER: SUPREME COURT The Supreme Court has converted the conviction of appellants from Murder (S. 302/149) to voluntarily causing grievous hurt by dangerous weapons (S. 326/149) under the Indian Penal Code on the basis of inconsistencies between oral testimony of witnesses and medical evidence on record. In this case, there were inconsistencies in the testimonies and evidence and that evidence could not be rejected on that ground. The High Court’s judgment notes the fatal injury does not correspond with the weapons used by the respondent. The court concluded that the conviction of the appellants under Section 302 of the IPC is not justified. The Court holds that there is abundant evidence to show that the appellants attacked the deceased with deadly weapons and therefore it is not a fit case for completely setting aside the prosecution case and converted the conviction from murder to causing grievous hurt by dangerous weapons.
