Wife capable of earning cannot seek maintenance. The Karnataka High Court in the case of Dr. E. Shanthi v. Dr. H. K. Vasudev held that a well qualified wife who was working prior to marriage cannot claim maintenance under section 24 of the Hindu Marriage Act. Although the wife may not be working after marriage, her qualification (in the present case, that of being a doctor) are sufficient to prove that the wife is capable of earning even though temporarily she may not be practicing. Hence, in such a case she is not entitled to the relief as claimed.
