WIFE CAN ASK FOR MAINTENANCE U/S 125 CRPC EVEN IF SHE RECEIVED ALIMONY: PUNJAB AND HARYANA HIGH COURT The Punjab and Haryana HC ruled that a wife can ask for maintenance u/s 125 of the CrPC even if she had previously received alimony from her husband. The couple was married for 10 years before splitting in 1993, after which the husband deposited a sum of Rs. 3 lacks as a final settlement for the past, present and future maintenance claims. Despite the finality agreed upon both the parties, the wife filed a case for monthly maintenance in 2007 in the Court of Pathankot Additional Sessions Judge. It was ruled in her favour. The husband approached the Punjab and Haryana HC where Justice Bhati found no disparity in the lower court’s judgment and allowed for a monthly maintenance of Rs. 15, 000/month from the husband to the wife.
