WHERE A BUILDER FAILED TO DELIVER POSSESSION TIMELY, THE NCDRC ORDERED MONETARY COMPENSATION. Several purchasers approached the Consumer Commission because of a delay in possession delivery and because of the differences between the brochure and the contract between the seller and the buyers. The complainant had purchased a unit in the development that had been allotted to someone else. The complainants were threatened with losing their allotment unless they made an exorbitant payment. Moreover, the complainants claimed that the builder had overcharged them for amenities that did not exist. The Commission ordered the builder to compensate the complainants at the rate of 6% per annum on the amount paid by them, to pay a lump sum of Rs. 1.00 lakh (per unit) for the facilities/features promised but not provided, to pay a sum of Rs. 25, 000/- as cost of litigation, to disclose the details in an open and truthful fashion, to complete the payments mentioned within three months, and to do so in a transparent manner.
