THE TRIBUNALS REFORMS BILL, 2021 The Central Government has introduced the Tribunal Reforms Bill, 2021 which lays down the Conditions of Service of Members of Tribunal. The Bill aims to amend the Cinematograph Act 1952, the Customs Act 1962, the Airports Authority of India Act 1994, the Trade Marks Act 1999, the Protection of Plant Varieties and Farmers Rights Act 2001 and certain other Acts. The Apex Court on 14th July had struck down the newly inserted Section 184 of the Finance Act, 2017 as amended by the Tribunal Reforms (Rationalisation and Conditions of Service) Ordinance, 2021 (ordinance) to the extent it fixed the tenure of members and chairperson of tribunals at 4 years. However, S. 5 which fixed the term of office at 4 years and some other provisions of the Bill run contrary to the Supreme Court judgement.
