THE ICC ARBITRAL RULING AGAINST ANTRIX HAS BEEN OVERTURNED BY THE DELHI HIGH COURT, WHICH HAS UPHELD A SINGLE-JUDGE ORDER SETTING ASIDE THE AWARD. By signing the arrangement, Antrix committed to developing, launching, and operating two satellites that would then be used to lease spectrum capacity to Devas. Devas used this bandwidth to provide India-wide multimedia services. Nevertheless, Antrix ended the contract in 2011 because of changes in policy. The two sides then engaged in heated legal proceedings against one another. The International Criminal Court issued its ruling in Devas' favour on September 14, 2014. However, a single judge's order set aside the award. The Delhi High Court held that setting aside the ICC Award based on fraud and contradiction with the national policy of India was the correct decision reached by the learned single judge. The appellant's argument that the single-judge lacked jurisdiction to hear the case since public policy and fraud were at issue under Section 34 is thus without merit. In its decision, the division bench said that any transaction contaminated by fraud must be treated with scorn by the courts since fraud is contrary to all equitable principles.
