DEFAULT BAIL AN INDEFEASIBLE RIGHT, CAN’T BE SUSPENDED : DELHI HIGH COURT The Delhi High Court stated that default bail is a fundamental right which flows from Article 21 of the Constitution and cannot be suspended while granting bail to dowry death accused. The Court issued directions so that the rights of undertrial prisoners to seek default bail are not defeated and custody of an undertrial is not extended mechanically as in the present case.
