Supreme Court exercises power under article 142 to dissolve marriage The husband filed a petition for divorce on grounds of mental cruelty and desertion by wife. The trial Court and High Court held that there is no proof of cruelty. The parties were living separately for more than 16 years. The Apex Court held “that marriage between the parties is emotionally dead and there is no point in persuading them to live together any more.
