SUPREME COURT CLOSES CRIMINAL PROCEEDINGS AGAINST ITALIAN MARINES IN INDIA AFTER PAYMENT OF RS. 10 CRORE COMPENSATION BY ITALY The Supreme Court has ordered the closure of proceedings against two Italian Marines who were accused of killing two Indian fishermen in 2012. Eight months ago the Permanent Court of Arbitration ruled that while the marines cannot be tried by India since they enjoyed immunity as Italian state officials, India would be entitled to compensation for the loss of life since its freedom and right of navigation was violated. This Award was binding as India is a party to the United Nations Convention on the Law of the Sea (UNCLOS). Accordingly, 10 crore rupees compensation has been paid by Italy. The amount shall be distributed to the families of the 2 victims and the boat owner.
