Sexual intent necessary for offence under POCSO Act - Bombay High Court Section 7 of the POCSO Act clearly defines the existence of sexual intention as a necessity to attract the offence of sexual assault to a child. This was held by the Court in the case where the accused was booked under various sections of the POCSO Act, while hearing his bail plea. FIR was filed by the victim’s mother stating that he had touched the child’s cheeks in his business premises. Mere touching the cheeks of a child without sexual intent would not attract the provisions of this act.
