RASH DRIVING IS NOT AN OFFENCE IF PEDESTRIAN WAS HIT WHILE NOT USING A ZEBRA CROSSING The ongoing case since 2017 where a 30 year old man was accused under Sections 279 (Rash and Negligent Act) and 304A (Causing death by negligence) for killing a woman while she attempted to cross the eastern express highway has finally been decided in favour of the accused on 27th August 2021. The verdict was that killing someone while driving rashly/negligently does not constitute an offence if the victim in question had not used a zebra crossing. The court further held that the prosecution failed to establish negligence on behalf of the accused and set the man free.
