However, when the appointment file was sent to the District Inspector of School for approval, it was refused sanction reasoning that the advertisement was published in a newspaper which had low circulation in the area. Mishra's challenge was dismiss, he challenged before the High Court noted that the advertisement was made in a newspaper, which hardly had any circulation in the area. And held if the vacancy is not informed properly, it is in violation of others fundamental right Article 14 and Article 16 of the constitution.
