Petition for divorce by mutual consent can be presented before the expiry of one year. The Delhi High Court in the case of Sankalp Singh v. Prarthana Chandra held that in certain cases of exceptional hardship or exceptional depravity on part of the Respondent, the courts may allow a petition to be presented before one year has elapsed since the date of marriage.
