ONLINE GAMING BAN STRUCK DOWN BY MADRAS HIGH COURT The Madras High Court has struck down and declared Part II of the Tamil Nadu Gaming & Police Law (Amendment) Act, 2011 as unconstitutional. Part II of the Act banned betting or wagering in cyberspace and even included a ban on games of skill for a wager, bet, money, etc. The court reprimanded that the above legislation has to be regarded as something done by the legislature capriciously, irrationally and is excessive and disproportionate. While declaring the entirety of the amendment as ultra vires to the constitution, the Court state that the Act in its application is disproportionate to the objects that it sets out to achieve that no meaningful part of it can be reasonably allowed to be retained or upheld as valid.
