No obligation to arrest under Sec.170 Crpc; Supreme Court
The Hon’ble Court held that ‘custody’ under Sec. 170 Crpc does not imply an obligation on the police to arrest each and every accused at the time of filing the chargesheet but calls for presentation of the accused by the investigating officer before the Court while filing the chargesheet.
