No maintenance to wife under section 125 of CrPC if wife deserts husband. The Uttarakhand High Court in a recent case has held that if the wife is living separately without sufficient cause and reason and if the wife refuses to live with her husband by deserting the shared household, she hands over her right to claim maintenance under section 125 of CrPC. The court has held that in such cases the Court can reject the wife's application to seek maintenance on the ground of desertion without substantial cause.
