National Consumer Disputes Redressal Commission passed a salient ruling stating that, “in case of occurrence of hacking and fraudulent withdrawal of money from a person’s bank account, the bank will be liable to bore the responsibility of the loss, and not the customer, i.e. if the hacking was done due to an error in the bank’s electronic banking system.” It is to be noted that in the occasion the fraud is due to the negligence of the customer himself then he will have to suffer the loss. However, in a situation where it is not the fault of the customer or the bank then the customer must file a complaint with the bank within three working days so as to dodge the responsibility of the loss incurred.
