MERELY APPROACHING NCLT BEFORE SEEKING AN APPOINTMENT OF ARBITRATOR COULD NOT BE CONSIDERED AS FORUM SHOPPING: DELHI HIGH COURT In a case where the respondent gave the petitioner a work order for electrical works in its residential project and a payment dispute ensued, the Delhi High Court held that the scope of enquiry in proceedings before the NCLT and before an arbitrator are absolutely distinct. Therefore, it could not be stated that the petitioner engaged in forum shopping just because he filed an application before the NCLT prior to requesting appointment of an arbitrator.
