Maintenance under section 125 of CrPC and under Hindu Marriage Act are independent of each other. The Bombay High Court in a judgement has held that the provisions of maintenance given under section 125 of Code of Criminal Procedure and under the Hindu Marriage Act are independent of each other and the wife is entitled to claim maintenance under both these provisions. The Court held that no law bars the wife to claim maintenance under both these provisions. However the Court shall decide the amount of maintenance only after taking into consideration all the multiple applications for maintenance filed by the wife under the provisions of both these laws.
