Kerala High Court Permits Construction Of Commercial Building Contrary To Town Planning Scheme The Kerala High court approved the construction of a commercial building on the site reserved for a residential complex that was set up as per the town’s planning scheme. The petitioner was aggrieved by the communication issued by the Kozhikode Corporation which directed that certain defect to be cured in order to be eligible for a building permit. The petitioner contended that the defects were unsubstantial in law. The court disposed the writ petition directing the respondents to consider the application of the petitioner in accordance with law, without insisting on compliance of the aforementioned defects, within 30 days from the date of receipt of a copy of the judgment.
