IS 30-DAY WAITING PERIOD NECESSARY UNDER SPECIAL MARRIAGE ACT: KERALA HIGH COURT ASKS THE CENTRAL GOVERNMENT The Kerala High Court recently in its order opined that the 30-day waiting period under Special Marriage Act, 1954 is necessary, rejecting the plea of the petitioners to grant them interim relief from the court in the form of a direction to the marriage officer to conduct an enquiry and register the marriage without waiting for 30 days. The petitioner’s contention was that the statute was enacted in 1954, technological advancements especially in communication were not as developed as they are now.
