HUSBAND OF A PROPERTY OWNER HAS THE LOCUS STANDI TO FILE A SUIT OF CRIMINAL COMPLAINT AGAINST A TRESPASSER The Jammu and Kashmir High Court has laid down that the husband of a purchaser of property has all rights to look after and protect the property of the wife and has the locus standi to file an FIR for offences committed against such property. The Court further went on to state that FIR’s can be filed by any third party also who is aware of the commission of any cognizable offence. These observations were made by Justice Oswal while hearing a plea which sought to quash the FIR registered by the husband (Respondent) for commission of offences under Section 427 and Section 448 of the IPC.
