FINANCIAL CRISIS CAN BE ONE OF THE GROUNDS FOR CONDONATION OF DELAY: GUJARAT HIGH COURT The Limitation Act of 1963 mentions the doctrine of delay condonation. The Act establishes time limits for certain lawsuits and specifies the time frame in which a lawsuit, appeal, or application may be filed. The expiry of such time period leads to extinguishing the remedy of the aggrieved party. In a recent decision, the Supreme Court concluded that, given the parties' and country's economic conditions, the financial crisis might be regarded one of the reasons for delay condonation. Sometimes the tiniest range delay is unforgivable owing to a lack of acceptable explanation, whereas in certain other cases delay of very long range can be condoned as the explanation thereof is satisfactory. "It is axiomatic that condonation of delay is a matter of discretion of the Court. Section 5 of the Limitation Act does not say that such discretion can be exercised only if the delay is within a certain limit. When delays occur on part of one party, the other party suffers litigation expenses as well. Therefore, the Court must compensate opposite party for the loss.
