FAMILY COURTS MUST ADOPT A LITIGANT FRIENDLY APPROACH AND DO AWAY WITH HYPER-TECHNICALITIES The Delhi High Court in the case of Ajay Dubey v Annapurna has opined that Family Courts must adopt a litigant friendly approach and not create complexities for clients by getting too hyper-technical. The Court further stated that the main function of these Courts is to relieve the parties of their ongoing suffering and this should be ensured by either settling the dispute amicably or through the Court’s determination. The Court in this scenario was hearing a plea for a mutual divorce petition filed jointly under Section 13-B of the Hindu Marriage Act, 1955.
