EXISTENCE OF A DISPUTE IS NOT A PRE-REQUISITE TO FILE A MUTUAL DIVORCE The Chhattisgarh High Court has laid down that there need not exist a prior dispute before filing for a mutual divorce under Section 13B of the Hindu Marriage Act, 1955. The bench has stated that unlike the pre-requisites required under Section 13 of the Act, a mutual divorce needs no prior dispute for it to be considered. The Court has also remarked that if an application has been duly filed and complied with, then it is not in the Court’s powers to find for a preexisting ground of dispute between the parties.
