Every cruelty is not an offence under Section 498A Indian Penal Code 1860 The Bombay High Court in a judgement has held that cruelty must be of such a degree as contemplated by the section i.e. it must be wilful conduct of such a nature as is likely to drive the woman to commit suicide or to cause grave injury or danger to life, limb and health of the woman. The Court further stated that it has to be kept in mind that it is easy to accuse somebody of ill-treatment after the victim dies but it is not wise to convict somebody based on such general statements.
