DISPOSAL OF COVID-19 VICTIM BODIES V. PARSEE LAST RITES The Gujarat High Court while rejecting a petition filed by the Trust representing the Parsee Zoroastrian Community held that, “Even the fundamental rights to profess, practice or propagate religion, and the right to manage religious affairs, as enshrined under Articles 25 and 26 of the Constitution of India, are subject to public order, morality and health.” In the present case, the petitioner sought permission to allow the Parsee community to follow their traditional last rites for those who succumbed to the Covid-19 Pandemic. This is on light of the Covid-19 Guidelines on Dead Body Management which ignores other religious practices of funeral/disposal of bodies.
