DISCIPLINARY ACTIONS AGAINST AN EMPLOYEE AFTER FOUR YEARS OF RETIRMENT In the particular case the retired Chief Engineer, served under the chargesheet on the irregularity he has committed during his employment for U.P. Rajkiya Nirman Nigam Limited from 2006 to 2011, there was the departmental proceeding was going on against him for past four years i.e. from the date of his retirement which is barred under provision of the regulation 351-A of Civil Service Regulations as applicable in Uttar Pradesh. The court upheld the petitioner's argument and held that the initiation of departmental proceedings against him after more than four years from the date of his retirement was indeed barred. The court further held that since the departmental proceedings were initiated after the four-year limitation period had expired, the punishment order was a nullity. Consequently, the court set aside the order directing the deduction of the petitioner's pension.
