DELIVERING USED/ DEFECTIVE CAR DESPITE FULL PAYMENT UNFAIR TRADE PRACTICE: SUPREME COURT OF INDIA The Supreme Court has ruled that delivering an old or defective model car against booking for a new car made by a person who paid full sale consideration is unfair trade practice. The complainant had alleged the vehicle was delivered to him after one year of the deposit of the total amount and also claimed the car delivered to him was old and was used by the dealer as demo-test drive vehicle. The NCDRC had modified the order passed by the district forum and directed that compensation of Rupees One (1) Lakh be paid to him, this decision was further challenged in the Apex court. The court held that even to deliver the defective car against the new car was not permissible. The bench also held that the NCDRC had acted beyond the scope and ambit of the revisional jurisdiction conferred under Section 21(b) of the Consumer Protection Act, 2019.
