DELHI HC ASKS CENTRE TO SUBMIT A REPORT ON A PERMANENT MECHANISM DEALING WITH INTER-COUNTRY ADOPTIONS The Delhi HC presided by Justice Pratibha Singh has asked the Ministry of Women and Child Development to submit a report for the creation of a permanent mechanism of inter country adoptions under the Hindu Adoption and Maintenance Act. The Court observed that currently inter-country adoptions are being dealt with by the Adoption Regulations, 2017 framed under the Juvenile Justice Act and is regulated by CARA and no provision of adoptions dealing with an NOC exists under the HAMA. The court while passing the order stated that whenever an inter-country adoption takes place under the HAMA and an NOC is required for any purpose which includes an issuance of passport or a visa, a special committee will be appointed to the verify the particulars of an application that has been filed before CARA.
