Delaying access to medical assistance is violative of Articles 21 and 19(1)(d) Recently, a division bench of the Telangana High Court, of Chief Justice Hima Kohli and Justice B Vijaysen Reddy, has stayed the guidelines issued by the state government prohibiting inter-state travel of ambulances and patients. The court noted that no state action can be validated which results in delaying or preventing medical access to patients in dire need, as this would amount to a violation of the sacrosanct right to life under Article 21 and would also be a fetter on the right to move freely enshrined under Article 19(1)(a) of the Constitution. The bench further observed that the state is under an obligation to take steps for preserving the life of the citizens, rather than creating impediments to access medical services.
