Courts at seat of arbitration have exclusive jurisdiction to regulate arbitral proceedings A Supreme Court Bench of Justices RF Nariman and Hrishikesh Roy has ruled on 13.04.2021 that the moment a place has been chosen as the seat of arbitration, exclusive jurisdiction is vested in courts at the particular agreed place, to regulate arbitral proceedings related to that matter (M/s Inox Renewables Ltd. v. Jayesh Electricals Ltd.). It was clarified by the apex court that the parties may mutually arrive at a seat of arbitration, and are at liberty to change said seat by means of a mutual agreement. Once changed, the previous seat no longer holds jurisdiction. In other words, choosing a place as the seat of arbitration is akin to an exclusive jurisdiction clause.
