The court noted that there are various situations in cases of marital discord where a child's passport application may need to be considered by authorities, and no hard and fast rule can be applied. The court rejected the argument that the rule only applies to single, unwed parent and clarified that the language used in the clause is merely regarding the single parent. The court stated that this order shall not be treated as a precedent.
