BENEFIT OF COMPASSIONATE APPPOINMENT SCHEME CANNOT BE DENIED TO CHILDREN BORN OUT OF SECOND MARRIAGE A plea was filed in in the Telangana High Court by a man whose application for compassionate appointment was rejected on the grounds that he is an illegitimate child and born out of a second marriage. The Telangana HC, while giving due acknowledgement to the apex courts judgement in Union of India v. V.R. Tripathi held that “Children born out of second marriage cannot be treated as illegitimate children”. The court, thus, allowed the petition and directed the respondents to consider the case of the petitioner for compassionate appointment by taking into consideration the law laid down by the Apex Court in Union of India v.
