Bail is rule & jail is exceptional – can be deviated owing to circumstances of the case & attitude of the accused. The High Court of Madras, in Chandrasekaran v. State, opined that in cases of honour killing, courts must be wary in releasing accused on bail, particularly, when hostile, belligerent and remorseless attitude was exhibited by accused. If such circumstances prevail, the bail can be cancelled u/s 439(2) CrPC, 1973
