APPLICATION OF NDPS ACT FOR POSSESSING CODEINE-BASED COUGH SYRUP: DELHI HIGH COURT The Delhi High court recently considered the question of whether manufactured drugs containing a minuscule percentage of narcotic substances should be distinguished from illicit drugs in mixtures under the NDPS Act. The Court observed that in a hypothetical situation, if a family having chronic cough problems was to procure 10 bottles of cough syrup before a trip, for them to be deemed to be in possession of a commercial quantity of Codeine and face 10 years of imprisonment could not be in consonance with the true meaning of the legislation. The matter has been directed to be placed before the Chief Justice, so that a larger bench may be constituted to discuss the broader issues raised.
