A person cannot be deprived of his right to property (Article-300 A) by executive fiat without any legal authority: Jharkhand High Court The Jharkhand High Court in the case of Sandip Khanna v. State of Jharkhand 2020, has held that a person cannot be presumed to maintain status quo unless the court by a specific order grants the same having taken into consideration the facts, applicable law and judicial pronouncement. The court further mentioned that the Revenue Officer is supposed to know the basic law and should not act in without any jurisdiction, so as to infringe the petitioner’s right to property in an arbitrary manner.
